Texas DWI Law

Under Texas Penal Code § 49.04, it is a crime for anyone to drive a motor vehicle in a public place while intoxicated. A DWI offense is a Class B misdemeanor and punishable with a minimum jail term of 72 hours. However, if the driver had a blood, breath, or urine alcohol concentration of 0.15 or more, they can be charged with a Class A misdemeanor. Section 49.04 also makes having an open container of alcohol in the car a Class B misdemeanor.

Sobriety or Alcohol Tests and Consent

Evidence of intoxication include the observations of the arresting officer, and the results of field sobriety tests or chemical tests. Drivers have the right to refuse to submit to a field sobriety test (FST). However, all drivers licensed by the Texas Department of Motor Vehicles have given implied consent to submit to a chemical test to determine alcohol content, such as a breath, blood, or urine test.

Although drivers are deemed to have impliedly given consent to a chemical test, drivers still have the right to refuse to submit to one. Police must receive voluntary consent from the driver before administering the test. However, refusal to submit to a chemical test may be used as evidence against the driver.

Importantly, implied consent only applies to situations where the driver was already arrested for a DWI. However, a lawful arrest requires the police to have probable cause that the driver was drunk at a minimum. That is why police conduct preliminary sobriety tests such as FSTs and preliminary breath tests. Drivers may also refuse to submit to a preliminary sobriety test. However, in some situations, refusal may provide the officer with probable cause to arrest the driver for DWI.
